right of withdrawal

The customer has the right to revoke this contract within fourteen (14) days without giving reasons. The cancellation period is fourteen (14) days from the day

a) the conclusion of the contract (this applies in the case of a service contract or in the case of digital content that is not supplied on a physical medium);

b) on which you or a third party designated by you who is not the carrier took possession of the goods (this applies in the case of a purchase contract);

c) on which you or a third party named by you, who is not the carrier, took possession of the last goods (this applies in the case of a contract for several goods which you have ordered as part of a single order and which be delivered separately);

d) on which you or a third party named by you, who is not the carrier, took possession of the last partial consignment or the last piece (this applies in the case of a contract for the delivery of goods in several partial consignments or pieces) ;

e) on which you or a third party designated by you, who is not the carrier, took possession of the first goods (this applies in the case of a contract for the regular delivery of goods over a fixed period of time).

In order to exercise the right of withdrawal, the customer can contact us (Eye Golf GmbH, Wolfsberg 211, 8421 Schwarzautal, Austria, email: office@eyegolf.eu , phone number: +43 699 1717 3696) by means of a clear statement (e.g. by email ) of his decision to revoke this contract. He can use the attached sample revocation form, which is not mandatory, especially since the declaration of revocation is not bound to any specific form.

In the case of a written cancellation notification, it is sufficient to meet the cancellation deadline for the customer to send the communication regarding the exercise of the right of cancellation before the cancellation period has expired.

Consequences of revocation

If the customer withdraws from this contract, we shall owe him all payments that we have received from him, including delivery costs (with the exception of the additional costs resulting from the fact that the customer chooses a different type of delivery than the cheapest one offered by us has chosen standard delivery) immediately and at the latest within fourteen days from the day on which we received notification of his cancellation of this contract. For this repayment, we use the same means of payment that the customer used for the original transaction, unless something else was expressly agreed with him; under no circumstances will the customer be charged for this repayment. We may refuse repayment until we have received the goods back or until the customer has provided proof that he has sent back the goods, whichever is earlier.

The customer must return or hand over the goods to us immediately and in any case no later than fourteen days from the day on which he informed us of the cancellation of this contract. The deadline is met if the customer sends the goods before the period of fourteen days has expired. We bear the costs of returning the goods if the return is from Germany and Austria. The customer bears the direct costs of returning the goods from all countries with the exception of Germany and Austria. The customer only has to pay for any loss in value of the goods if this loss in value is due to handling that is not necessary for checking the nature, properties and functioning of the goods. “Checking the nature, properties and functionality” means testing and trying out the respective goods, as is possible and customary in a retail shop.
